Hi team, a debt buyer sued me for $593, in response to my answers, I request for a private arbitration according to the original debtor paypal credit card agreement.
I did not file motion to arbitrate. The court ordered for a mediation on 7/14/2023. I want to know my way around this. The attorney of the plaintiff responded and said if I will pay the full cost of the arbitration fee then they are OK to arbitration but if not then the court should proceed with hearing and they stated that this case is not real estate where a contract is been breached.
I responded and let the court know I wasn't responsible of paying the cost of arbitration per the credit agreement.
Can I file motion to compel private arbitration and dismissed the case in court?
What is the best option and what do I need at the mediation for this Friday? Thank you
