I lost the MSJ because my sister as the power of attorney signed the responses on my behalf as I was out of the state and the court
would not allow an extension on the hearing. To make it safe I gave my sister the power of attorney to sign and deliver the responses in time.
Also the Judge relied on the Plaintiffs declaration and a summary of the charges which reflected payments that were not from me
but from a corporation account. Had the plaintiff provided the actual check it would have shown the name of a company on the
check and not me.
There are other material facts that because of the non- admissibility of my responses were not taken into consideration.
The debt belongs to a LLC where I was the managing director of.
