Cavalry Attempt to Collect on Old Account

I have an interesting collection effort by Cavalry.  This DC attempted to collect on an old account.  Their first letter stated the routine info about an effort to establish a pay schedule on an alleged debt.  At the end of the letter was a statement "The law limits how long you can be sued on a debt.  Because of the age of your debt, we cannot sue you for it, even if you make a payment or promise to make a payment and Cavalry will not report it to any credit reporting agencies."

I sent them a DV letter and disputed their claim.  They did respond with a charge off statement, and copy of an agreement from Bank of A, the original holder.  It had the same statement of cannot sue in it.  This debt is beyond the statue of Limitation for me in Michigan. 

I also have documents from the first collection attempts back in 2013, where I took them to the brink of Arbitration.  They failed to make the initial payment to JAMS who first placed it on administrative suspension for lack of payment and subsequently closed it.

My questions are was this simply an attempt to catch me to make some payment to them?  Or are they just making some vain attempt to have me feel an obligation to pay.  Should I respond with a letter referencing my previous JAMS case or just ignor the whole thing.  They cannot sue so they have no claim.

I see an account that is marked in trade lines in collection and would like to know if this is a charge off or collection. Also is the balance $486 the high credit? in the HighCred field it just shows N/A.

I received a voice mail from a at firsted wasa machine then a man got in the line on Saturday 1/11 . he stated he received paper work at his office today with my name and social. Attached to it. He is advising me he has a request to put me on his list to obtain a signature for a certified notice of intent for a pending legal claim filed against me. Before he stops be my residence or place of employment he wanted to give me a courtesy call to infom me I am being put in his schedule to be served. he left the number of the claiment if i have any questions or want mire info about the matter. He repeated he will be out to serve me this Friday between 1-7. Either at my job or residence and for me to have a valid picture ID and/or supervisor to serve as a witness. I called the number left and its "asset location sevices llc" I could not get ahold of anyone maybe because its Saturday. My question is do I call them to find out what its about? How much info do Igive them about myself if I call? Should I just wait until Friday to see if he shows? Not sure what its about. I do have some debt but do not want to be scammed. I checked my CR and this company is not on it. Also, my brother received a call a week prior from a man stating he needed to serve me about a clain and if I didn't know anything about it for me to call the number he left. I did and it was a differnt company called nationwide?? Any advise would help.

So I just got back from court with ceeeyeare and they had nothing (IMO)— no original document, no witness...just his tablet with some images of letters with my address on them that he said were proof that I was making payments on that account (I asked him if he had the actual letters and he said he didn’t need them, that “that’s not how it works”. I told him, unless he has original docs, that we had nothing more to discuss. This all happened before the actual trial, btw.

Anywho, by the time the trial actually got underway, he started by asking the judge for an extension due to the fact that his witness could not make it...the judge granted that request EVEN AFTER asking if there was any explaination as to why the witness was a no-show with the lawyer unable to offer ANY reason whatsoever. Am I wrong in assuming this is all BS on the lawyer’s behalf? That he has NO proof that I owe this debt?

I digress... at that point I asked the judge for a dismissal on the grounds of insuffient evidence on the plaintiffs part but the judge shot me down and I agreed to a new date in late July.

I think I should have probably asked if it was possible (or demanded) to just continue the trial right then and there but I didn’t think to do so, at the time unfortunately.

Does anybody have any thoughts on how this went down or what I should do or expect the next time out?

Some opinions, please

A few months ago, I received a debt collection letter from Midland Funding.  I found a validation letter on another site and sent it to Midland.  All they sent me was a copy of the original creditor’s charge off statement.  

I have been doing more research and from what I have found on this and other sites, the letter I sent requested things that were not required for Midland to send me.  

Does anyone have any opinions about this article?   I know the letter is wrong   What do you think about the rest of the advice?

Final Pre-Legal notification

Midland finding in the last 2 months showed up as a collection account on my credit report. Yesterday I received a final pre legal notification. I'm in Florida. The original debt of with Old Navy through Synchrony bank. I heard something about I can elect arbitration if they decide to sue me. but I just don't understand. Can someone help me please

Here is what happpend, ti started 2 months ago.

 

 

1. I got a summon and complaint.

2. I filled a response.

3. I got a court date a month ago.

4. I just had a surgery and needed couple of weeks to recover therefore I requested a reschedule.

5. 3 days ago I received a letter in the mail from the attorneys who Midland hired.

 

 

It states.

 

"Plaintiff requests that the court strike the motion of summary judgement hearing from the docket that was scheduled......Court date....

 

 

What does this mean?

 

I checked online and the date for the hearing has been cancelled but the case is still open when I view it online.

 

 

New Scam Call

LOL I have not received one of these in almost a year and got one today.  Toll free number called and went to voice mail:

  "My name is Kenneth Oler, this is an urgent message.  We have made several attempts to contact you and are awaiting your return call today.  I am with the legal offices of SSG and Associates we have been retained.  We are handling multiple infractions with this case.  If you would like to settle this matter before we seek appropriate relief from arbitration or from any proper jurisdiction at all I strongly  suggest you or your legal representative immediately upon receipt of this message or press 1 to speak with a live agent.  My toll free number is 866-484-5312."

Trying to decide if I call back or make him sweat a bit more and try again.

Midland Credit Management Pre-Legal Notification

So I have been sent a pre-legal notification from MCM. I have done a lot of reading and see that this is one of the scare tactics that they use to get payment. I am not being sued and this is from MCM and not an attorney based in my state(South Carolina).  Should I send a DV letter to them. 

On the bottom of the pre-legal notification it says that I may request the following information in writing and the same will be provided to you at no cost within 30 days of receipt of your written request: 1) An account statement or complete transactional history, as applicable, reflecting your name, the last four digits of the account number at t he time of charge-off, and the charge-off balance and/or claimed balance, excluding any past charge off payment; 2) A listing of all prior owners of this account and transfer information; 3) Documentation evidencing the transfer of ownership of the account to Midland Funding; 4) An account statement or complete transactional history reflection purchase, payment or other actual use of the account or a signed document reflecting the opening of the account at issue, 5) an explanation of how any amount we are seeking to collect in excess of charge-off was calculated; and 6) If applicable, the terms and conditions applicable to the account. 

With the amount of detail should I assume that they do in fact have all this information on me or should I send a letter and see what they send back?  I will post a template that I found in a second post to get some opinions on that template. 

Desperate need of a credit card user agreement

Hello,

 have not posted here in a long time.I had a hearing today for a 15K debt that Citi Card sold to Portfolio recovery Associates.(The usual disclaimer here..Bad year of business medical bills etc and I was unable to pay Citicard actually the first legal issue of my lifetime)Anyway I am trying to remove the case to arbitration (following detail of fisthardcheese arbitration strategy)I had printed off a citicard agreement that  and the judge like and agreed with what it said about arbitration and was ready to to Accept my MTC but it actually does not say Citi Dividend on the agreement nor CITI at all even tho I printed it from Citi Website.He has given me 21 days to come up with the agreement for my specific card and he will grant My MTC.

  Since I have defaulted with Citibank They have not agreed to help me on the phone by Providing me with the Citibank World dividend user agreement from when i had the card(In 2016 they changed the branding to "World Cash Back card") so the exact title Citibank World Dividend no longer exists.So my entire case actually rests on if I can find this agreement.I intend to call citibank 10 times a day and maybe somebody will help me but nobody wants to.If by chance anybody on here has a Citi world dividend or Citi dividend agreement from 2016 or before I will make it worth your time to send me a copy :)

Guys i need  opinions. Got a call from JDB lawyer and we talked about options. One that i was thinking about is a consent or stipulated judgement. They  will settle for 40% of amount with what ever monthly payment i set until its paid (no length of time) and will not file it unless i default on payments. What you guys think?

I am being sued by PRA in PA and just filed an answer to the complaint with the court.  Just wondering what i should do as next step in the the process.  Should or Can i start a discovery asking the Plaintiff for Product of documents right away or does this need to be granted first by the court? Thanks so much for any suggestions or recommendation.

I've read over the forums for a couple hours and found the arbitration option.

I have and had 4 - 5 year old debts (most of it I paid off a couple years ago before I knew there were other options) one of which, Gurstel is coming after.

I am wondering if I should try to settle this debt, but then again, it is SO OLD and I really don't want to. I work for myself, so I have a lot of time, I somewhat understand the courts, how to look up statutes and how to file, just enough to be dangerous! :) Any help is appreciated!

I found this on another post and thought it might be helpful to anyone responding:

 

1. Who is the named plaintiff in the suit? I have not been served yet, but on Gurstels' paperwork current creditor is Cavalry SPV I, LLC

2. What is the name of the law firm handling the suit? (should be listed at the top of the complaint.) Gurstel Law Firm

14. Did you request debt validation before the suit was filed? Yes, I have their return letter with statement dated 4/5/2015, I stopped paying on this well before 2015.

  This website has been a wealth of knowledge in the past and I have shared it with family an d friends, Thank You.

I could really use advice on a JDB scenario going on now.

Being sued in Texas Justice of the Peace Court. I filed original defendant response for dismissal. I'm inclined to settle for way less. Should I call the law firm, email, mail, a settlement offer or wait to hear from the firm?

Credit One is original creditor

LVNV is JDB

original credit limit is 900, amount being sued for is 1350.

Has anyone been summoned to court by Advance Financial in Nashville?   They are a horrible, unethical creditor ( check BBB & other credit sites) with a ruthless & very "famous" debtor attorney, apparently.  They've already been paid 2.5 times the amount loaned, have not contacted me for 7 months, then a summons comes from a lawyer with very little info or notice.   I don't have time or $$ to be  more thorough with them, so will do a Sworn Denial for now.   This attorney has a gazillion other former customers on the docket that day, so I am wondering if the judge will just blow me off & give a summary judgement?!  Help. does anyone here have any experience with  Davidson Co, TN General Sessions and/or fighting Advance Financial?

I'm being sued in Middle TN by Portfolio.  Havene't been served yet so I'm not sure how much or who the OC is.

 

I've been through this before in 2003 and again in 2008 and got rid of them without paying them a dime.  (I was around for the Art of Credit days, LOL!)

 

Back then a JDB couldn't establish the chain of custody and used hearsay affidavits that could be easily defeated.  Now it looks like arbitration is the way to go and I am wondering why.

 

Have we really been punked by 'self authenticating' documents and rules of evidence that took away our hearsay defenses?

 

They have a form for a 'Sworn Denial' but I'm wondering if that's enough.

Was sued by a 3rd party junk debt collector. Won MTC Arbitration in court. I just recieved a letter stating that the Arbitrator is not accepting the filing. AAA was who the complainant's attorneys filed with. What's next?
