NEED HELP FINDING ARBITRATION AGREEMENT FOR CITIBANK, N.A. Personal Loan in my name that is not me/not my debt
Someone stole my identity and used my name to secure a 10K loan. It's not my debt, and thus far, after many efforts Citibank won't stop contacting me about this debt, and further refuses to stop harassing me. I've sent dozens of certified letters, FTC identity theft affidavit, and even tried disputing it with the credit bureaus. Still, nothing changes and the company refuses to cooperate. They won't even give me a copy of the loan agreement.
I would like to sue them in JAMS arbitration for violations of the FCRA and violations of my state and federal laws. I would hope that it will motivate them to take it off my credit reports and leave me alone. BUT, to do this, I need to find a copy of the personal loan agreement with a valid arbitration clause, because the company refuses to cooperate and has NOT furnished one.
The arbitration clause must show it's mandatory and that they pay for it or how fees are handled. I tried googling it and I only find arbitration clauses for credit cards, not personal loans for Citibank. Can someone else please help me find a valid personal loan agreement for CitiBank that has a JAMS arbitration clause? Apparently, this loan was opened in Dec 2017, but they are just now collecting on it and I had not been contacted except for last year and this year by that company. CitiBank has threatened to sue me in correspondence and has ignored each and every debt validation letter I sent them. I don't know what to do. I also tried complaining to the CFPB and the company simply responded with a few sentences that they believe they are collecting a valid debt, and again, they would not furnish the requested items. I don't know what to do except sue them at JAMS. If anyone can please help me find the arbitration agreement for personal loans with CitiBank, N.A. I very much want to get this negative history off my credit report ASAP and send a strong message to CitiBank.
