My husband had a loan that went into collections earlier this year. It was through Lending Club. They sold the debt to Credit Corp Solutions. They are charging 6% interest on the debt, and I cannot find anything in the original contract or within the validation notice they sent that makes this legal. I read that this isn't allowed under FDCPA, unless the original contract or my state allow it. How can I confirm this is valid? Is there specific language I can look for? If I am able to confirm this isn't valid, how do I proceed in challenging the interest charged? We were trying to create a repayment plan on their website but on the actual charged off debt only.
