I defaulted on several credit cards back in August 2024. Couldn't afford groceries and I lost clients in my job and just couldn't pay them. I am married, live in TN which is a non community property state and have been a self employed child care provider for 26 years. I get paid in cash. I'm having health issues and currently only keeping children when school is out so have no income except for summer and school breaks. I already have a judgement against me from 2017 and filed my exemptions with the court clerk back then which includes my bank account and they were never able to collect anything to this day.
Citi and Chase are 2 of the credit cards I defaulted on this year. I got tired of them blowing up my phone and sent them both a cease letter telling them that after consulting with an attorney I understand I'm judgement proof so even with a judgement they will not be able to collect on it.
I now just received a notification from UPS that Citi is sending me something. Chase sent me a letter asking for my attorney's information. I never said I hired an attorney only that I consulted with one. I owe a little over $2000 to Chase and about $3500 to Citi.
I'm certain I'm judgement proof. My husband is currently not listed on the cards and they were in my name only. I did add my husband as a user to the chase card when I applied but he had his name removed from the account because he didn't know I added him. After that they sent an email saying he was removed and his card will no longer work. That was back in 2023. He can't be sued for my debt in TN since it's a non community property state. I'm just concerned that because he was originally on it as a user but was removed they might try to sue him. Can they do that?
