I would appreciate advice on how to proceed with Stenger and Stenger. I have been self employed 27 years. I'm paid in cash. I live in a non community property state, the Citibank card I defaulted on was in my name only. I have been sued before back in 2017 on a different card and filed my exemptions with the clerk so judgment on that has never been collected on. My attorney at that time didn't make it to my court date and a default judgement got entered but my lawyer said I'm collection proof. I listed my bank account as exempt and they have never been able to collect.
Now all these years later I defaulted again on a Citibank card and just received a letter from Stenger and Stenger. I honestly don't even want to waste the energy asking for validation and playing this game. I have read numerous cases against them online. They are repeated fdcpa violaters. My debt is $3700. I know they are about to sue. I'm planning on filing my exemptions with the clerk again just like last time and not sweating this but should I tell them I'm collection proof? It probably won't matter will it? They will still file suit? I'm struggling and depressed and can't afford food so definitely can't afford to pay them. This firm seems ruthless from everything I've read and I just can't handle anymore stress on top of everything else I'm currently going through. Should I even respond to their letters? In the past requesting validation drew attention to my case and got me sued. Id like to not be sued but am still collection proof regardless.
