I need some help. I have been fighting my battles with debt collectors and learning as I go. My fiance just received a call from a debt collector...Allied financial solutions to collect on a 5+ year old Huntington account. They have called his family as well. He had them email a collection letter. This is the first he is hearing about it. They are trying to collect on behalf of Huntington bank for a bank account with overdraft charges. My fiance doesn't recall anything with a Huntington account having overdraft charges. We are going to check his CR, but the letter is just a general letter saying they will settle for $1000 and he must pay in 2 days or he is being threatened with a lawsuit. It has an account number, but no sale info..nothing to mean that they are representing Huntington bank except for the name..no statement copies. Is there a SOL on bank accounts? What record keeping do we need to do at the start of this process for FDCPA violations?
