Received civil summons in KY on June 3, 2017 from Midland Funding, LLC for $759.22. Original creditor Citibank Best Buy. Attorneys Fenton & McGarvey out of Lousiville. Had attached as Exhibits: Affidavit of officer/employee of Midland, Bill of sale and assignment from Citibank to Midland, Asset Schedule that has been redacted, Affidavit of sale of Account by Original Creditor, Certificate of Conformity, Data sheet on myself with "data printed by Midland credit managment, inc from electronic records provided by Citibank pursuant to the bill of sale/assignment of accounts transferred on or about 3/26/14 in connection with the sale of accounts from citibank to midland", statement dated 11/21/2013 showing balance of $759.22, and statement dated 5/21/2013 with a balance of $525.79.
Need to respond by June 23, 2017. I have been reading extensively and am exhausted. I'm really nervous about this and need advice. This is one of many credit cards that I defaulted on when my husband was diagnosed with cancer and we were no longer could pay due to his care costs. I separated and moved from NM to KY in 2/2015. When I recently checked my credit report, I found that Midland had persued and was granted a default judgement for about $4,700 in NM without them having jursidiction over me or serving me in any form. My mail was being forwarded. But first need to handle the time bomb of June 23 quickly arriving....then, I plan to try and get removed. I also want to find out how do you keep the others from following suit once they start this?
Where do I get an example of how to file an answer to this? Do I use standing or KRS 371.050? I previously worked for an attorney several years ago and am getting quite nervous and stressed out about this. I just need to get done. Are there any other suggestions on what to use? What do I need to be prepared for next? I'm new to this Forum thing and need help and detailed instructions on how to do things here. Any help is greatly appreciated.
